Wavenet S.A. Service Agreement

As a provider of Internet access, web hosting, and other Internet-related services, Wavenet offers its customers (also known as subscribers) the means to acquire and disseminate a wide range of public, private, commercial, and non-commercial information.
Wavenet recognizes that the Internet provides a forum for open and free discussion; however, when commercial interests are at stake, Wavenet reserves the right to take certain corrective and preventive actions. To protect these interests, Wavenet has developed an Acceptable Use Policy (“AUP”), which elaborates on certain provisions outlined in the contracts with each customer and is intended to serve as a guide to the rights and obligations of customers who use Wavenet’s services. This AUP will be reviewed on an ongoing basis, and customers can find it available at www.wavenet.com, where access to the site constitutes the customer’s acceptance of these additional changes to the AUP.
An important aspect of the Internet is that no one owns or controls it. This fact greatly influences the Internet’s openness and value but also leaves many matters to the discretion of the Internet user—both as a sender and as a receiver of information.
When subscribers obtain information via the Internet, they should bear in mind that Wavenet cannot monitor, verify, or guarantee the quality of the information users may receive. Therefore, users must exercise their own judgment regarding such information while remaining vigilant against any sexually explicit or highly offensive material posted on the Internet. Consequently, Wavenet cannot accept any liability toward its customers for the consequences of offensive, illegal, or unsolicited communications.
When customers publish information online, they must understand that Wavenet cannot review, edit, censor, or assume responsibility for any information its customers may create. When users transmit information over the Internet, they have the same rights and obligations as other authors with regard to copyrights and potential infringements, defamation, etc. In this regard, as this information circulates through the Wavenet network, it may reach a large number of people, including both Wavenet customers and non-customers. For this reason, customers will be deemed to have violated Wavenet’s Acceptable Use Policy and the Service Agreement when they engage in the following prohibited actions:
Sending unsolicited email and/or unsolicited commercial messages over the Internet (known as “spamming”). This is not only due to the negative impact it may have on consumers’ perception of Wavenet, but it can also overload the Wavenet network, preventing the service offered to the customer from being provided at the highest quality. Similarly, maintaining an open SMTP gateway is prohibited. When a complaint is received, Wavenet has the authority to determine whether or not it meets the criteria that violate the rules or to determine that spamming has occurred.
Customers who violate this prohibition will have their service immediately suspended for a period of no less than 72 hours and must pay a fine of $300 + VAT to Wavenet as a penalty for breach of contract.
The use of pointed domains or redirects via redirect codes to simulate the hosting of multiple websites under a service that includes only one website is not permitted. Any redirects detected as being used for this purpose will be immediately removed from our DNS servers.
This includes any activity that infringes upon or fraudulently appropriates the property rights of others, including copyrights, trademarks, trade names, trade secrets, software or applications, and patents owned by individuals, legal entities, or any other type of entity.
This also includes any activity that infringes on privacy rights, publicity rights, or any other personal rights of others. Wavenet is required by law to block access to customer content that violates the provisions above. It is also Wavenet’s policy to terminate the privileges of any customers who repeatedly violate intellectual property laws.
If you use the Wavenet network to broadcast, promote, store, or display any information containing child pornography or obscene language or material, Wavenet is required by law to notify the appropriate law enforcement agencies of such publication so that it may be immediately removed and legal action taken.
Using the Wavenet network to transmit or download defamatory, abusive, or threatening language.
Falsified message headers used to conceal the true content of the message.
Unauthorized or illegal access to other computers or networks – Illegally or without authorization accessing computers, accounts, or networks belonging to another party, or breaching the security systems of other systems (known as “hacking”). In general, any activity that could be considered a breach of a system.
Distributing information on the creation of viruses, Trojan horses, mailbombing, pinging, or any other type of electronic attack agent. This also includes activities that interfere with others’ ability to use the network or connect to the network, system, service, or equipment.
Promoting, transmitting, or enabling any type of application, program, product, service, or software designed to violate this AUP, including facilitating the use of mass email (spam) in any form.
Exporting encrypted software over the Internet.
Wavenet reserves the right to refuse submissions from newsgroups when it becomes aware that such messages violate the AUP.
Any activity considered illegal, including the promotion, transmission, or facilitation of any type of fraudulent business.
Any other type of activity that Wavenet may determine to be contrary to its customers, reputation, good standing, or relationships with third parties.
As previously mentioned, the responsibility for preventing activities that violate the AUP lies primarily with the customer. Wavenet, as a matter of standard practice, will not monitor its customers’ communications to ensure compliance with this policy or with applicable laws at any given time.
When Wavenet detects any activity that violates any of these provisions, it will take action to stop such activities, including, without limitation, removing the information, taking down a website, blocking offensive transmissions via filters, denying Internet access, or taking any other action deemed appropriate.
Wavenet is aware that many of its customers are themselves Internet service providers and that much of the information regarding Wavenet’s customers may be generated by those customers’ own customers. Wavenet does not require its customers to monitor or censor communications or websites created by their customers. Wavenet reserves the right to take direct action against a customer of a Wavenet customer.
Likewise, Wavenet may take action against its customer for reasons arising from its customers. In this regard, Wavenet advises that customers offering Internet services must cooperate with these measures. Failure to cooperate with these measures taken by Wavenet will be considered a violation of the AUP.
Wavenet is mindful of the privacy of online communications and websites. In general, the Internet is neither more nor less secure than other forms of communication—including mail, fax, and voice telephony—since almost anything can be intercepted. As a precautionary measure, Wavenet urges its customers to assume that their online communications are insecure. Wavenet cannot assume responsibility for data transmission.
Wavenet will not intentionally monitor private email sent or received by its customers unless required by law, legal authorities, or when public safety may be at risk. Wavenet may, however, automatically monitor its service to determine whether resources are operating satisfactorily. Likewise, Wavenet may disclose information about a customer or a transmission made via the Wavenet network or a website to comply with a court order, subpoena, regulation, or government request.
Wavenet assumes no obligation to inform its customers that such information has been disclosed, and this lack of obligation may become a prohibition if required by law. Finally, Wavenet may disclose customer information or information transmitted through its network when necessary to protect Wavenet and others from fraudulent activities.
Wavenet expects its customers who provide Internet services to others to fully comply with all applicable privacy laws. A customer’s failure to comply with these laws will constitute a violation of Wavenet’s policy.
Finally, Wavenet wishes to emphasize that by accepting the Service Agreement, customers agree to indemnify Wavenet for any violation of the Agreement, any law, or any Wavenet policy that results in a loss or a claim against Wavenet by a third party. This means that if Wavenet is sued as a result of a customer’s actions, the customer must pay all damages incurred by Wavenet, plus court costs and attorneys’ fees.
